　Throughout the American past the use of privately owned land often gave rise to harmful consequences for other landowners or the general public.　(a)Hence innumerable disputes broke out as to where to draw the line between the use and the misuse of land, and courts were frequently called upon to sort out rights and wrongs.　During the years of rapid economic development in the nineteenth century, courts often argued that the adverse consequences of development were acceptable because of the resulting material public benefits and if people were harmed in the process, that was a penalty society had to pay for material progress.　(b)After World War Ⅱ, however, considerable interest arose concerning the harm that private enterprise brought to the general public, and there were demands for measures to reduce harmful practices.　The interest in environmental quality was an integral part of that new attitude.

(a)　そのため，土地の正しい使い方と誤った使い方の境界線をどこで引くべきかについての議論が数えきれないくらい多く巻き起こり，その正誤を解決するために裁判が招集されることがよくあった。

(b)　しかし，第二次世界大戦後，民間企業が一般世間にもたらす害について大きな関心が集まり，有害な行為を取り締まるための対策が求められた。
